Formal sentencing Wednesday afternoon for Anthony Oddone, convicted of 2008 manslaughter in Southampton Bar

Anthony Oddone, the 31 year old Farmingville man who pleaded guilty to first degree manslaughter for recklessly causing the death of an off-duty Suffolk County Corrections Officer in a Southampton bar in 2008, will be formally sentenced tomorrow afternoon (March 19) in criminal court in Riverhead.

Oddone’s conviction following a seven week trial in 2010 was overturned by the Court of Appeals in December. The court ruled Oddone’s attorney should have been allowed to challenge the recollection of a witness testifying how long the defendant held the victim Andrew Reister in a chokehold. Reister, 40, was formally declared brain dead on August 9, 2008, two days after the confrontation.

Oddone will be sentenced to five years and four months (the time the defendant has spent behind bars in an upstate prison) and five years of post-release supervision when he is sentenced Wednesday afternoon at 2:30 by State Supreme Court Justice C. Randall Hinrichs (fourth floor of the courthouse).

Oddone waived his right to appeal his criminal conviction.

He is free in lieu of $500,000 cash bail.
